III. Ensure the compensation of both bodily injury and material damage of parties injured by foreign vehicles in Belgium.

Under the law, it is the Belgian Bureau which is in charge of claims handling and settling. However a formal claim addressed to the Bureau itself is not always required.

Indeed, it is possible that the foreign vehicle is covered by a valid policy of insurrance issued by a foreign company which appointed a correspondent (handler) in Belgium. It is not forbidden for the injured party to address a claim directly to this correspondent. However, legal procedures shall only be conducted by the victim against the Bureau.

In practice, the Bureau proceeds as follows :

1. If the foreign vehicle is correctly insured and the foreign company has a correspondent in Belgium : The Belgian Bureau will transfer the claim to the correspondent who will handle and compensate the claim in the name of the Belgian Bureau. If the foreign company has not designated a correspondent, the Belgian Bureau will handle the claim.

2. If the foreign vehicle is not correctly insured, the procedure will vary according to the vehicle's country of registration.

a) The vehicle is registered in a country having signed section III of the Internal Rules between Bureaus European Economical Area ( EU + Norway, Lichtenstein, Iceland) , Croatia en Switzerland or Serbia ( as from 1 january 2012) Green card verification at borders between these countries is prohibited . The Bureau of the vehicle's country of registration stands as guarantor to cover vehicle liability even if the vehicle is not correctly insured. The Bureau is held to settle in this case if there is proof that the vehicle involved in the accident was normally based in a signatory state. This concept of "normally based" is related to the vehicle's registration. If it is not possible to determine that the vehicle is normally based in one of these countries, it is useful to direct the claim towards the Belgian Guarantee Fund.
